A comprehensive overview of the conflict of interests with the focus on how to prevent it.
Objectives
The course aims to provide clear guide to identify, manage, and prevent conflict-of-interest situations within public administrations, in order to avoid civil, criminal, and disciplinary liabilities.
Target
Public administration employees, consultants, and managers, and all the people subject to the application of anti-corruption regulations.
Program and Contents
- Definition of conflict of interest.
- Relevant case studies and scenarios.
- Code of Conduct classifications:
- Kinship, marriage, regular social interactions, well-known friendships or enmities, significant credit/debt relationships.
- Disciplinary, criminal, and administrative-accounting sanctions for violations.
- ANAC guidelines for public employees:
- How to submit declarations, verification procedures, and rules on abstention.
- Conflict of interest in public procurement, with an analysis of the relevant provisions in the new Public Contracts Code (D. Lgs 36/2023).
- Sector-specific conflicts of interest:
- Health sector (relations with pharmaceutical companies and suppliers), judiciary, civil and military police forces.
- Post-employment conflicts of interest:
- “Pantouflage” and the ban on appointing retired personnel to specific roles.
- National regulations on ineligibility and incompatibility of appointments:
- Key cases under D. Lgs. 39/2013, and management of appointments following criminal convictions.
- Procedures for challenging ineligibility or incompatibility.
- ANAC’s role and recommendations.
- Conflict of interest in extra-institutional assignments for public employees:
- Assignments exempted by Art. 53(6) of D. Lgs. 165/2001, those requiring authorization, and prohibited ones.
- Related disciplinary consequences.
- Pantouflage dynamics, both upon entering and leaving public service:
- Obligations and risks for former public employees or private-sector professionals.
- Transparency obligations as a preventive measure against unlawful appointments.
- Review of recent case law and examples.
- Liabilities and sanctions arising from conflict-of-interest violations.
ISSUANCE OF THE CERTIFICATE OF FREQUENCY AND PROFIT
The CEIDA has applied for renewal of accreditation with the Lazio Region, following the adaptation of facilities to ensure full accessibility, in accordance with current regulations. Pending the confirmation of accreditation, the certificate of attendance and profit will still be issued, subject to reservation, according to the procedures provided by the regulations currently in force.
