Description
Administrative procedures are at the core of public sector decision-making and service delivery. This course explores the legal and operational framework, from the beginning of a procedure to its final decision. According to article 103 of the Italian Constitution, which guarantees judicial protection against the public administration, the course analyzes roles, functions, and obligations of public entities and other involved stakeholders. Through practical insights and legal interpretation, participants will gain a full understanding of how to set-up, manage, and complete administrative procedures.
Objectives
The course provides the essential tools for an effective public recruitment competitions management, and control with a focus on long-term impact on the credibility and efficiency of public institutions. From planning to communication, through the selection process and resource management, each stage will be addressed problem-based to ensure successful outcomes.

Module 1
- Key actors in the procedure: the manager and the responsible official. Hot to manage conflicts of interest
- The pillars: cooperation, good faith, and proportionality
- Key criteria: efficiency, effectiveness, impartiality, publicity, and transparency
- When and how private law principles apply in public procedures
- Types of administrative procedures: mandatory vs. optional; initiated ex officio or upon request
- Fast-track procedures initiated by private request
- Time limits and duration: start, suspension, and end of the procedure
- Missing deadlines: substitution powers, disciplinary action, indemnities, and void decisions
- Compensation for damages caused by procedural delays
Module 2
- Starting the procedure: required content and recipients of the notice
- Identifying third-party stakeholders
- Consequences of failing to issue the notice
- Stakeholder participation and procedural interventions; limits and rights of access to documents
- The investigation phase: collecting documents from internal and external sources
- Managing self-certification: when it applies and how to use it
- Getting opinions and technical assessments: how to handle conditional or partial feedback
- Acquiring consents, approvals, and clearances; implications of administrative silence
- Coordinating through a services conference: types (preliminary, decisional), procedures, timelines, and consequences of dissent
- Notification of intention to reject an application: providing reasons, accepting observations, and limits on changing grounds post-annulment
Module 3
- Alternatives to formal procedures: certified notice of commencement (SCIA)
- Ways to conclude the procedure: explicit decisions, tacit approvals, or substitute agreements
- Supplementary agreements and their impact on justification
- Resolving disagreements between the responsible official and the manager
- Legal implications of tacit consent (silence-assent)
- How procedural flaws affect the legitimacy of the final act
- Administrative self-review and powers of withdrawal or annulment

ISSUANCE OF THE CERTIFICATE OF FREQUENCY AND PROFIT
The CEIDA has applied for renewal of accreditation with the Lazio Region, following the adaptation of facilities to ensure full accessibility, in accordance with current regulations. Pending the confirmation of accreditation, the certificate of attendance and profit will still be issued, subject to reservation, according to the procedures provided by the regulations currently in force.
