A comprehensive overview of the administrative inspection: tasks, rules, procedures.
Objectives
The seminar provides both theoretical and operational tools for all professionals involved in inspection procedures—whether acting as inspectors or as the inspected parties. It focuses on ANAC’s rules, the amended Law 241/1990, D. Lgs. 123/2011, Law 15/2009 (Art. 4, letter i), and above all, the Anti-Corruption Law 190/2012.
Target
Managers, administrative, technical, and support staff from central and local public administrations, local health authorities (ASL), public economic bodies, and independent authorities.
Program and Contents
- Framework, definition, and objectives of administrative inspections according to Law 190/2012. Inspection powers.
- The role of inspections according to Law 190/2012 and ANAC inspections.
- Scope and limits of inspection powers. Internal (intra-administration) vs. external (on private entities or other administrations) inspections. Inspections by the Department of Public Administration and the Ministry of Economy and Finance.
- Inspection techniques. Protection of the inspected party.
- Administrative procedure fundamentals and how Law 241/1990 affects inspections:
- Notice of initiation, right to access, and participation.
- Phases of the inspection process: initiation, investigation, conclusion.
- Drafting of the inspection report: format, key content, and common errors.
- Types of liability arising from inspection duties:
- Civil, criminal, administrative-accounting, disciplinary, and managerial liability.
- Current developments in inspection functions and relations with internal controls:
- Differences between DPR 286/1999 and 267/2000.
- The “Frattini” directive on inspection activities.
- Anti-corruption compliance and outcomes of inspections.
- Mandatory reporting of damages to public finances and criminal offences:
- Techniques for drafting and presenting reports.
- Consequences for failure to report (guidelines from the Prosecutor General at the Court of Auditors).
- Inspector’s powers and methods for evidence collection.
- Privacy regulations: impact of the Consolidated Law No. 196/2003 on access to data and documents by inspectors.
- Judicial rulings on access to inspection files.
- Inspections to tackle absenteeism and illegal conduct in the public sector.
- Coordination between inspection bodies and anti-corruption officers.
- Inspection activities and the Court of Auditors after D. Lgs. 174/2016.
ISSUANCE OF THE CERTIFICATE OF FREQUENCY AND PROFIT
The CEIDA has applied for renewal of accreditation with the Lazio Region, following the adaptation of facilities to ensure full accessibility, in accordance with current regulations.
