Description
The course explores the evolution of administrative justice with a specific focus on the digital transformation. It analyzes the Administrative Trial Code (D. Lgs. no. 104/2010), its amendments and implementing decrees, with particular attention to public procurement and the digital administrative process.
Objectives
- To understand the fundamental principles of administrative justice and the different types of jurisdiction.
- To examine how both ordinary and special administrative proceedings work.
- To explore the rules on access to documents, silence of the administration, interim measures, and enforcement procedures.
- To assess the impact of digitalization through the Technical-Operational Rules of the Digital Administrative Trial (PAT).
Target
Public administration executives and officials, lawyers, legal advisors, public procurement officers (RUP), and professionals involved in contentious or non-contentious procedures with public authorities.
Program and Contents
- The administrative justice system: evolution, guiding, influence of EU, current regulatory framework.
- The administrative process according to the Code (D. Lgs. No. 104/2010), and other amendments (D. Lgs. No. 195/2011, 160/2012, 33/2013), and further updates — especially concerning public procurement (e.g. Legislative Decree No. 50/2016 and Decree Law No. 32/2019).
- Measures introduced by Title IV of D. Lgs. No. 90/2014 (as amended by Law No. 161/2016) to streamline the enable its digital transformation.
- Types of jurisdiction of the administrative judge and key principles with jurisdiction, territorial competence and procedural contents.
- Available legal actions before the administrative judge. Judicial appeal. Precautionary phase, with a focus on pre-litigation protection. Enforcement and appeal of precautionary measures.
- Special procedures. Simplified rulings and enforcement of first instance decisions.
- The technical-operational rules for the digital administrative trial: D.P.C.M. No. 40 of 16 February 2016.
- Compliance proceedings. Litigation on administrative silence and powers of the judge. Penalty fines imposed on the P.A.
- The administrative trial for public contracts: procedural rules introduced by D. Lgs. No. 53/2010 and Legislative Decree No. 195/2011; measures for further acceleration under Decree Law No. 90/2014 the Public Contracts Code (D. Lgs. No. 50/2016, as amended).
- Special administrative proceedings, including:
- Proceedings to protect access rights
- Civic access (Art. 5 of D. Lgs. No. 33/2013, as amended)
- Injunction procedures against the P.A.
- Simplified decisions and enforcement of non-suspended first-instance rulings
- Rules on means of evidence and court-appointed technical experts
- Class actions for the efficiency of public administrations and public service concessionaires (D. Lgs. No. 198/2009)
ISSUANCE OF THE CERTIFICATE OF FREQUENCY AND PROFIT
The CEIDA has applied for renewal of accreditation with the Lazio Region, following the adaptation of facilities to ensure full accessibility, in accordance with current regulations.
