INTRODUCTION
The programme aims to outline the features of pension litigation, as well as to summarise the main features of the Italian social security system following the harmonisation process with reference to public pensions through recurring and emerging cases examined by the Court of Auditors.
OBJECTIVES
– To illustrate the scope of the accounting pension jurisdiction (compared to civil litigation in social security and welfare matters), the conduct of pension trials at first instance and on appeal (focus), the role of the Sezioni Riunite and the nomofilactic function.
– Summarise the main features of the Italian social security system following the harmonisation process with reference to public pensions through recurring and emerging cases examined by the Court of Auditors. Recall the categories and concepts acquired while attending the entire Master in Social Security through concrete case studies (as this is the last lesson of the Master).
– Through specific anchorages of the accounting procedural law to the substantive discipline on the subject, identify the instruments for the protection of the pensioner and the possible procedural conduct of the Administration evoked in the pension judgement, grasping its constraints and opportunities.
CONTENTS
– Introduction. Background overview and review session of the main features of the Italian pension system following the harmonisation process.
– The breadth of pension accounting jurisdiction. The conduct of pension trials at first instance and on appeal (focus). The nomofilactic function. Specifically, the following topics will be dealt with in this order:
– The sources of the pension process
– Civil, military, war pension litigation
– The pension process in the context of the Code of Accounting Justice
– The bodies of pension jurisdiction and the plea of lack of jurisdiction
– The application and inadmissibility of the appeal
– Regime of notifications
– Constitution of the defendant and defence of the PP.AA.
– Interlocutory proceedings
– Preliminary investigation phase
– Discussion and decision of the case
– Delivery and enforceability of the judgment
– Investigative powers of the judge and the court-appointed expert witness in proceedings before the regional courts
– Appeals, with particular reference to the pension appeal and revocation
– The execution of sentences and the judgement of compliance
– The Joint Sections and the nomofilactic function.
– Recurring and emerging cases of application examined by the Court of Auditors: the protection of the pensioner and the procedural conduct of the administration sued.
With regard to the expected results, please refer to the objectives outlined above, with a focus on the strategies and defensive conduct of the public administration summoned to court.
ISSUANCE OF THE CERTIFICATE OF FREQUENCY AND PROFIT
The CEIDA has applied for renewal of accreditation with the Lazio Region, following the adaptation of facilities to ensure full accessibility, in accordance with current regulations.
